By accessing or using NotanPro™ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Description of Service

What NotanPro™ Provides

• AI-powered composition analysis: Automated scoring and feedback on visual compositions
• Professional grid overlays: Rule of thirds, golden ratio, center cross, and diagonal guides
• Notan value studies: Simplified value analysis with adjustable levels
• Live camera analysis: Real-time composition guidance through device cameras
• Annotation tools: Ability to add notes and markers to images
• Download capabilities: Export analyzed images with grids and annotations

Service Availability

NotanPro™ is provided as a web-based software service. We strive for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be announced in advance when possible.

3. User Accounts and Registration

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person may not maintain multiple accounts
• You must notify us immediately of any unauthorized use of your account

Account Responsibility

You are responsible for all activities that occur under your account. This includes all content uploaded, analysis performed, and any charges incurred.

4. Subscription and Billing

Free Trial

• Duration: 7 days with full access to all features
• No credit card required: Trial begins immediately upon account creation
• Automatic expiration: Access is suspended when trial period ends
• One trial per person: Each individual is entitled to one free trial

Premium Subscription

• Pricing: $7.99 per month, billed monthly
• Payment processing: Handled securely through Stripe
• Automatic renewal: Subscription renews monthly unless cancelled
• Pro-rated refunds: No refunds for partial months of service

Cancellation

• Cancel anytime through your account billing portal
• Access continues until the end of your current billing period
• No refunds for unused portions of paid subscriptions
• Data retention for 30 days after cancellation for reactivation

5. Acceptable Use Policy

Permitted Uses

• Analyze your own artwork and photographs for composition improvement
• Use for commercial art projects and professional photography
• Educational use in art instruction and student learning
• Client presentations and portfolio development

Prohibited Uses

You may not use NotanPro™ for:

• Illegal content: Any unlawful, harmful, or offensive material
• Copyright violation: Analyzing images you don't have rights to use
• Harassment: Any form of harassment, bullying, or abuse
• Spam or abuse: Excessive requests designed to overload our systems
• Reverse engineering: Attempting to access or copy our AI algorithms
• Automated scraping: Using bots or scripts to extract data from our service
• Reselling access: Sharing account credentials or reselling our service

6. Intellectual Property Rights

Your Content

• Ownership: You retain all rights to images and artwork you upload
• License to us: You grant us limited rights to process your images for analysis
• No public use: We never display, share, or use your content publicly
• No AI training: Your images are not used to train our AI models
• Deletion rights: You can delete your content at any time

Our Intellectual Property

• NotanPro™ software: Protected by copyright and trade secret laws
• AI algorithms: Proprietary analysis systems and scoring methods
• Trademarks: NotanPro™ name and logo are registered trademarks
• User interface: Design and functionality are our intellectual property

Downloaded Content

• Downloaded images with grids and annotations are yours to use
• Images include subtle NotanPro™ watermarks for attribution
• Commercial use permitted for Premium subscribers
• You may not remove or alter watermarks

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Service Limitations and Disclaimers

• File size limits: Images must be under 10MB in JPG, PNG, or WebP format

9. Limitation of Liability

To the maximum extent permitted by law:

• Service provided "as is": No warranties of any kind, express or implied
• No consequential damages: We are not liable for lost profits, data, or opportunities
• Limited liability: Our total liability is limited to amounts paid for the service
• No professional advice: NotanPro™ does not provide professional artistic or business advice

10. Indemnification

You agree to indemnify and hold harmless NotanPro™, its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or analyze through the Service

11. Termination

Termination by You

• You may cancel your subscription at any time
• You may delete your account through account settings
• Cancellation takes effect at the end of your billing period

Termination by Us

We may suspend or terminate your account if you:

• Upload prohibited or illegal content
• Abuse our systems or other users
• Fail to pay subscription fees

Effect of Termination
